Terms of Service (Terms & Conditions)

These Terms of Service ("Terms") govern the access and use of the CarePixel platform (website, apps, provider dashboards, and related services). By using CarePixel, you agree to these Terms.

1. Definitions

• "CarePixel" / "Platform": The technology platform operated under HungryPixel Technologies (OPC) Private Limited.
• "Provider": Clinics, hospitals, doctors, nurses, and healthcare service professionals offering services via CarePixel.
• "User" / "Patient": Any person using CarePixel to browse, book, pay, or manage healthcare services.
• "Booking": An appointment, online consultation, home visit, or home-care service request initiated via CarePixel.

2. Platform Role (No Medical Services)

CarePixel is a technology platform that facilitates discovery, booking workflows, coordination, and payment collection support for Providers.

CarePixel does not provide medical advice, diagnosis, prescriptions, or treatment and does not guarantee clinical outcomes. All healthcare services are provided by independent Providers.

3. Eligibility

You must be legally capable of entering a contract under applicable laws. Providers must represent that they have the right licenses and permissions to deliver services as applicable.

4. Payments & Collection on Behalf of Providers

• Payments on CarePixel are collected on behalf of Providers.
• CarePixel may facilitate payment processing through third-party payment gateways.
• CarePixel may deduct applicable platform fees and payment gateway charges where contracted, and settle the remainder to the Provider as per agreement and applicable regulations.
• Providers are responsible for issuing invoices/receipts where required and for applicable taxes and compliance.

5. Subscriptions (Providers)

Provider subscriptions (clinics/hospitals) are non-refundable once activated, unless explicitly agreed otherwise in writing.

6. Bookings, Availability & Fulfillment

• Provider availability displayed on the platform is managed by Providers and may change.
• Providers are solely responsible for delivering booked services.
• CarePixel is not responsible for delays, cancellations, or service quality, but may assist in coordination and customer support.

7. Telemedicine & Online Consultations

CarePixel encourages Providers to follow the Indian Telemedicine Practice Guidelines, 2020. However, each Provider remains responsible for compliance, clinical conduct, and record-keeping.

8. User Responsibilities

Users agree to:

• Provide accurate personal and booking information
• Use the platform lawfully
• Follow appointment instructions and Provider policies
• Not misuse the platform (fraud, abuse, impersonation, unlawful activity)

9. Prohibited Activities

Users and Providers must not:

• Engage in fraud or unauthorized payments
• Upload unlawful, harmful, or misleading content
• Violate privacy or intellectual property rights
• Attempt to access restricted systems or data

10. Suspension & Termination

CarePixel may suspend or terminate access for suspected misuse, policy violations, fraud, or legal non-compliance.

11. Disclaimers

CarePixel disclaims warranties to the maximum extent permitted by law. Medical outcomes and clinical responsibility remain with Providers.

12. Limitation of Liability

To the extent permitted by law, CarePixel is not liable for:

• Medical outcomes or Provider negligence
• Indirect, incidental, special, or consequential damages
• Losses arising from Provider actions or omissions

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Jurisdiction shall lie within India.
